1. CONDITIONS AND LIMITATIONS OF LIABILITY:
AceClub and its agencies are not responsible for failed, partial or garbled computer transmissions, or for technical failures of any kind affecting the Entry in any manner, including but not limited to electronic malfunction or damage of any network, hardware or software.
If you are a winner of a prize, AceClub is not responsible for any delay or failure by a third party (including any email or communications provider) to deliver the prize, or any delay or failure relating to the Prize itself (including any negative encounter experienced by you including but not limited to cancellation of any orders purchased with the prize; service interruptions, crashes or other technical errors on any site) or failure by any third party to meet any of its obligations in connection with the prize.
Persons entering the Prize further agree not to knowingly damage or cause interruption of the Prize and/or prevent others from participating in the Prize. CAUTION: ANY ATTEMPT TO DAMAGE ANY ONLINE SERVICE, WEBSITE OR PLATFORM OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION VIOLATES CRIMINAL OR CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE, ACECLUB WILL DISQUALIFY ANY PERSON, WHETHER OR NOT THE INDIVIDUAL IS A PARTICIPANT IN THE PROMOTION MAKING SUCH ATTEMPT AND SEEK DAMAGES TO THE FULLEST EXTENT OF THE LAW
The Released Parties do not make any representation, warranty or guarantee, express or implied, relating to the prizes, and are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment, hardware, software or programming associated or used with the Prize; (2) technical errors, defects, delays or failures of any kind, including without limitation malfunctions, interruptions or disconnections in communications lines, Internet or website access, hardware or software; (3) digital or electronic disruptions, e.g., viruses; (4) unauthorized human intervention, e.g., hacking; (5) technical or human error which may occur in connection with any aspect of the Prize; (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Prize, access to, copying or downloading materials from PLAYACECLUB.com or any other website or receipt or use of any prize; or (7) for any cancellation, suspension or postponement of any type of Event or league, or event of force majeure.
ACECLUB MAKES NO WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATIVE TO THE USE OF ANY PRIZE, INCLUDING, WITHOUT LIMITATION, ITS QUALITY, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
2. DISPUTES; ARBITRATION/CHOICE OF LAW
Your name and billing address will be taken from your method of payment (credit card, debit card, etc.) You must grant access to your mobile phone or tablet’s camera and GPS to take part in any Prize. Only golfing holes with a registered yardage of over one-hundred-thirty (130) yards will be counted. You must frame the full tee box and golf hole in your camera, this means you can see the ball from tee shot to hole in full trajectory. The ball cannot leave the frame of vision. You must keep the camera on as you show us the ball inside the hole. AceClub holds all rights to validation of your hole-in-one as stated in the Master Terms and Conditions.
Multiple golf shots (i.e., multiple swings that make contact with the ball) in violation of the preceding limit and/or mass entry attempts, as determined by AceClub in its sole discretion, will result in disqualification of all entries by such person and perhaps legal and/or other sanctions. Entries must be played by the paying entrant; use of automated entry devices or programs, or entries by third parties are prohibited. Entries that do not conform to or that violate these Official Rules or are submitted in any manner other than stated in these Official Rules will be disqualified. By entering any Prize, entrants agree to these Official Rules and the decisions of AceClub, which are binding and final in all matters relating to any Prize.
3. Participation in Prizes
The Participation in Prizes terms apply to all AceClub prizes (each, a “Prize”). Each prize may have additional terms and/or rules of participation (“Prize Terms”), which will be posted or otherwise made available to you at or near the place of the Prize announcement. The Prize Term for each Prize in which you participate will be deemed incorporated into and form a part of these Standard Participation in Prizes Terms. In the event of any discrepancy or conflict between these Participation in Prizes Terms and any Prize Terms, then the specific Prize Terms shall govern and prevail. The Participation in Prizes Terms for each Prize in which you participate will be deemed incorporated into and form a part of these Master Participation in Prizes Terms. It is your responsibility to read the Participation in Prizes Terms to determine whether or not your participation, registration, or entry in the Prize will be valid or restricted, and to determine your participation requirements.
Eligibility: Each Prize is open only to individuals who at the time and date of entry are: (i) over the age of twenty-one (21); (ii) whose name matches the name on the credit card used to participate; (iii) physically located in the countries listed in the Play Ace Club Apple App Store; (iv) meet any eligibility requirements specifically set forth in the Prize Terms. Employees, officers and directors of AceClub, its parent company, and each of their respective affiliates, subsidiaries, advertising and promotion agencies, retailers, distributors, and each of such employees’, officers’ and directors’ immediate family members and/or those living in the same household (whether legally related or not) of each are not eligible to participate in any Prize or receive the advertised Prize. Additionally, AceClub reserves the right to refuse or otherwise restrict your eligibility to participate in any Prize for any reason, in our sole discretion, including based on your playing patterns or playing history or if you failed to take advantage of any previous Prize in good faith. Void where prohibited by law. If AceClub becomes aware of a participant who, in the course of participating in a Prize, has become able to guarantee hole-in-ones with no or only minimal risk, and/or benefits from a Prize by participating through more than one (1) Account, and/or displays irregular or unusual playing patterns which AceClub deems to be abusive, AceClub may elect to do any one or more of the following: (i) close the customer’s Account(s); (ii) invalidate the transactions or game play which was in contravention of this term; and/or (iii) withhold the customer’s Prize.
How to Qualify:To qualify for a Prize, during the offer period set forth in the Participation in Prize Terms (the “ Prize Period”), eligible individuals must PlayAceClub.com during the prize window. All gameplay is limited to one (1) golf shot per entry. To ensure that the Prize is limited to one (1) golf shot per entry, we reserve the right to only permit one (1) customer to participate from each household address, IP address, email address, telephone number, same payment account (e.g., debit or credit card, etc.), shared computer (e.g., public library or workplace), cellular phone (e.g., any and all smart phone or mobile access to our website), and tablets (any and all smart tablets with access to our site.)
Administration: The AceClub Parties expressly reserve the right to amend, suspend or terminate any Prize at any time without prior notice or consent. Administration of a Prize is at the sole discretion of the AceClub Parties. Any questions relating to eligibility, these Terms and Conditions or any other questions concerning a Prize will be resolved at the sole discretion of the AceClub Parties and their decisions will be final and binding with respect thereto. No groups, clubs, corporations, companies, partnerships, or organizations may participate in any Prize or reproduce or distribute any portion of these Master Participation in Prize Terms to their members.
Publicity Release: Subject to applicable law, participants irrevocably grant the AceClub Parties and each of their licensees, and its and their successors, assigns and sub-licensees, the right and permission to use their name, voice, likeness and/or biographical material for advertising, promotional and/or publicity purposes in connection with the Prize, in all forms of media and by all manners (now and hereafter known), and on and in connection with related products, services, advertising and promotional materials (now known or hereafter developed), worldwide, in perpetuity, without any obligation, notice or consideration.
Tampering with Any Promotion:The AceClub Parties are not responsible for the actions of entrants in connection with the Prize, including entrants’ attempts to circumvent these Master Terms or otherwise interfere with the administration, security, fairness, integrity or proper conduct of a Prize. Persons found tampering with or abusing any aspect of a Prize, or whom AceClub believes to be causing malfunction, error, disruption or damage may be disqualified. Additionally, any attempt to cheat a Prize, as determined at the sole and absolute discretion of AceClub, may result in immediate disqualification of the participant, as well as other possible consequences, including disqualification from any and all existing and future Prizes. ANY ATTEMPT BY A PERSON TO DAMAGE ANY WEBSITE (INCLUDING ANY MOBILE APP) OR UNDERMINE THE LEGITIMATE OPERATION OF A PRIZE MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, ACECLUB RESERVES THE RIGHT TO SEEK ALL LEGAL AND EQUITABLE REMEDIES FROM AND AGAINST ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. AceClub reserves the right, at its sole and absolute discretion, to disqualify any individual who is found to be, or suspected of, acting in violation of these Master Terms and Conditions, or to be acting in an unsportsmanlike, obscene, immoral or disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person.
Suspension / Modification / Termination:In the event AceClub is prevented from continuing with a Prize by any event beyond its control, including, but not limited to, fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, communications or equipment failure, utility or service interruptions, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), interference with a Prize by any party, or any federal, state, local or provincial government law, order, or regulation, order of any court or jurisdiction, or other cause not reasonably within AceClub’s control (each a “Force Majeure” event or occurrence), AceClub shall have the right to modify, suspend or terminate the Prize. AceClub additionally reserves the right, in their sole and absolute discretion: (a) to modify, suspend or terminate the Prize should causes beyond AceClub’s control corrupt or interfere with the administration, integrity, operation, security or proper play of the Prize; or (b) to disqualify any participant found to be, or suspected of: (i) tampering with the entry process or the operation of the Prize; (ii) acting in violation of these Master Terms and Conditions; or (iii) acting in an unsportsmanlike manner.
Release and Waiver of Liability: By participating and/or redeeming any Prize, participants agree to release, defend, indemnify and hold harmless AceClub and each of their respective parent corporations, subsidiaries, advertising and promotion agencies, affiliates, directors, officers, employees, representatives and agents (collectively, the “AceClub Parties”). from and against any and all liability claims or actions of any kind whatsoever (however named or described) for injuries, death, damages or losses to persons and property which may be sustained in connection with: (i) your participation in a Prize; (ii) the receipt, use or misuse of the Prize; and (iii) while preparing for, participating in, and/or traveling to any Prize activity, including those damages caused by the AceClub’s Parties’ own negligence. The AceClub Parties expressly disclaim any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use or misuse of a Prize. The AceClub Parties are not responsible for any incorrect or inaccurate information, including errors or typos in these Master Terms and Conditions, the Prize Terms or any Prize-related communication or materials, whether caused by the AceClub or participants, printing errors or by any of the equipment or programming associated with or utilized in the Prize.
